Section 21? What is a Section 21?   This Notice is used when a  Landlord requires the Tenant to vacate a rented property by a specified date. It must be used to legally terminate an Assured Shorthold Tenancy (AST). A Section 21 notice of possession operates under section 21 of the Housing Act 1988 and is the legal eviction notice that landlords can give to a tenant to regain possession of a property at the end of an Assured Shorthold Tenancy. Landlords can issue this notice to the tenant without giving any reason for wanting to end the tenancy.   Landlords have the legal right to retain possession at the end of a tenancy but must follow the correct legal procedure.

As you may be aware the government have made changes to the Section 8 and Section 13 prescribed notices which come into effect on 6th April 2016.

The notices have been revised under The Assured Tenancies and Agricultural Occupancies (Forms) (England) (Amendment) Regulations 2016.

 

In April 2016, the government have made minor changes to correct previous errors made in earlier legislation and the Section 8 notice makes reference to the Prescribed Section 21 notice.

These changes apply to tenancies in England only
